OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, IF ANY.

You and we agree to resolve disputes through binding arbitration rather than in court, except for qualifying small-claims or where otherwise required by law. You waive the right to a jury trial and to participate in class actions. The Federal Arbitration Act applies. The arbitrator’s decision will be final and binding.

16. Arbitration (European Union)

If you are in the European Union, you may have the right to use a certified out-of-court dispute settlement body to resolve disputes relating to certain decisions we take. We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board under the EU Directive on Consumer ADR.

17. Law and Jurisdiction
